When Can You Make a CICA Dog Bite Claim?

A dog bite may fall within the scope of the CICA scheme if the incident involved an element of criminal intent. That includes cases where:

  • A dog was used deliberately to threaten, intimidate or injure you
  • The owner encouraged the dog to attack as part of an assault or confrontation
  • You were the victim of a broader violent incident involving the use of a dog
  • You were injured while attempting to stop a deliberate dog attack on someone else. This does not cover an injury sustained defending a third party from a random non-criminal dog attack – you may still have a civil claim against the individual but not via the CICA

It is not enough that the dog was not simply out of control, it must be used as a weapon or you can show that the incident would, under UK law, be regarded as criminal act of violence. It is this criminal intent that distinguishes criminal dog bite cases from civil ones (where you would normally pursue a claim against the dog owner or their insurer).

There does not need to be a conviction; you may still qualify for an award, but the police must have been informed, in accordance with the CICA scheme, and the CICA must accept, on a balance of probabilities, that you were the victim of a crime of violence

What Does CICA Compensation Cover?

The Criminal Injuries Compensation Scheme provides fixed awards for physical and psychological injuries. In the context of a dog attack, this can include:

  • Bite wounds and lacerations
  • Permanent scarring or disfigurement
  • Psychological harm, including PTSD and anxiety
  • Loss of earnings where you are unable to work for more than 28 weeks; payment is based on the current level of SSP and begins in week 29 of your absence.
  • Special expenses (e.g. mobility aids, care, home adaptations)

Unlike civil claims, CICA awards are tariff-based and may be lower than what is recoverable from a standard civil claim where there is an insurer to pay the compensation. However, such claims remain a crucial route to justice when the offender is uninsured, untraceable or otherwise beyond the reach of civil litigation.

Making a CICA Dog Bite Claim: What You Need to Know

You must usually apply to the CICA within two years of the incident. However, there is discretion to extend this if exceptional circumstances prevented earlier application; something we can argue on your behalf if needed. If the injured party is a minor the two-year period starts on their 18th birthday. Further exceptions apply to people under a disability, if in doubt always seek legal advice.

The CICA requires:

  • Proof that a violent crime took place

  • Details of financial losses (if applicable)
